The family of late General Sani Abacha has appealed to the Court of Appeal in Abuja, seeking to overturn a Federal High Court judgment that dismissed their suit challenging the revocation of a property in Maitama, Abuja.
Hajia Mariam Sani Abacha and her son, Mohammed Sani Abacha, are praying the Court of Appeal to void the judgment and grant them ownership of the disputed property.
The Abacha family is contesting the lower court’s decision on 11 grounds, including errors in law and miscarriage of justice. They claim that the judge erred in holding that their claim was statute-barred and that they lacked locus standi to file the suit.
The appellants are seeking two major reliefs: voiding the judgment and invoking Section 15 of the Court of Appeal Act to take over the case as a court of first instance.
The respondents include the Minister of the Federal Capital Territory, Federal Capital Development Authority, President of the Federal Republic of Nigeria, and Salamed Ventures Limited.
The appeal is pending, with no date fixed for hearing.
